He claimed that Winzo, a well-known name in the gaming industry, generated more than Rs. 100 crores in revenue in the previous fiscal year by offering a variety of skill games like chess and 8-ball pool.
Senior attorney Sajan Poovayya raised concerns about the suit’s maintainability on behalf of the respondent Google and other interested parties, arguing that it dealt with issues of trade and commerce rather than IPR or information technology law.
The Supreme Court declared both DFS and Rummy to be games of skill, so Google Play, which previously did not offer a platform for any game involving “money-in, money-out” aspects, is introducing them.
In the Android market, he continued, Google Play was not the only app store.
The court remarked that Winzo was free to apply to Google to launch the two games separately on a separate app and then list them on its app store because Winzo also offered DFS and Rummy.
This case’s subsequent hearing will take place in November.
