Supreme Court directs Governor-nominated MLC not to take any action in respect of 12 MLAs Eknath Shinde Devendra Fadnavis

Mumbai In a setback to the Shinde-Fadnavis government, the Supreme Court has directed not to adopt any procedure for the 12 MLCs nominated by the Governor. The Supreme Court has given these directions on the SLP of petitioner Ratan Luth.

The new government had started preparing a new list by canceling the list of members appointed by the Governor given by the Mahavikas Aghadi government. But now it is clear that due to the direction of the Supreme Court, there will be further delay in the pending appointment of 12 MLAs. The High Court had expressed displeasure over the directions given to the Governor in this regard, but no decision was taken.

The hearing of the power struggle in Maharashtra is going on in the Supreme Court and the next hearing is likely to be held in October. Till then, the Supreme Court has directed that no process be initiated in respect of the 12 members appointed by the Governor.

List of Mahavikas Aghadi back
After the Maha Vikas Aghadi government came to power in the state, a list of 12 members appointed by the Governor was sent to Governor Bhagat Singh Koshyari. But the Governor neither gave the green signal to this list nor made any comment regarding the approval of the list. Even after the state government filed a petition in the court in this matter, the governor did not take any decision. Even after Uddhav Thackeray resigned from the post of Chief Minister, he had challenged the Governor on the issue of 12 MLAs.

After the Shinde-Fadnavis government came to power, they have decided to withdraw the list of 12 members given by the Mahavikas Aghadi. Now the preparations have started to hand over the new list from the Shinde government. Discussions have started that vigorous lobbying is going on from both sides regarding these 12 names. Looking at the strength of the MLAs, BJP is likely to get 8 seats out of 12 and Shinde 4 seats. Now the big question in front of Shinde and Fadnavis is who among these 12 names should be given a chance. In the 2019 elections, the people who came to the party taking Shinde and Fadnavis into confidence are losing in the assembly elections, the possibility of getting more opportunities cannot be ruled out. At the same time, many people are lobbying even after the term of the Legislative Council is over.
