Abhishek Manu Singhvi said that the disqualification proceedings and the hearing before the Election Commission are intertwined. Shinde Group has the option of disqualification or merger as per the Tenth Schedule. The group currently has the option of merger as per the Tenth Schedule. However, to avoid this action, the Shinde group approached the Election Commission under the provisions of the Constitution and claimed that they were the original party. Hearing before the Supreme Court before the Election Commission is like putting a cart before a horse. It has been claimed that there has been an attempt by the Election Commission to legitimize the illegal act. He asked if the Election Commission cannot wait till the hearing in the Supreme Court is over.

The Shinde group had filed a petition seeking permission to the Election Commission to hear the identity of Shiv Sena. After this, the Constitution Bench of the Supreme Court started hearing on the pending issues.
