Maharashtra Politics Prakash Ambedkar: To hear the claim made by Shinde Group against Shiv Sena Supreme Court to the Election Commission After flagging off (Election Commission), many reactions are coming on the result. In the hearing held on Tuesday, the Supreme Court approved the hearing regarding the election symbol of Shiv Sena. The Shinde group approached the Election Commission and claimed that the Shiv Sena party is theirs. On the other hand, a petition was filed in the Supreme Court demanding that the Election Commission should not hear the disqualification and other issues of the Shinde group MLAs till the completion of the hearing. The Constitution Bench of the Supreme Court, while hearing the petition on Tuesday, allowed the Election Commission to hear the matter. In this hearing, the lawyers of Shinde Group and the Election Commission had highlighted that the Election Commission is a constitutionally independent body.

Salah Prakash Ambedkar, while reacting said that the Supreme Court has given a decision regarding Shiv Sena. This decision of the Supreme Court is binding on all. But he said there were doubts whether the decision would be respected. The Constitution and Parliament upheld the neutrality of the Election Commission. Care was taken not to splash them. But the Election Commission prepared the ‘Election Symbol Order, 1968’ in its own right. According to section 15, if there is a dispute in any party regarding the symbol of the election, we can intervene.

On this occasion, the Supreme Court got an opportunity to examine whether Section 15 of the Election Symbols Order is constitutional or not. But unfortunately the matter has not been investigated. Therefore, the Election Commission was directed to take a decision in the matter of Shiv Sena. The Constitution and Parliament upheld the neutrality of the Election Commission. Prakash Ambedkar said that he was threatened by Durdeva’s decision. Prakash Ambedkar said that he believes that the message sent by this decision is wrong that the dispute within the party will be decided by the Election Commission. He expressed doubts that the decision raises the possibility that the EC is on the way to Frankenstein (a threat to the system). Ambedkar also requested the Supreme Court to review its decision.
