Hearing of EWS on 10 percent reservation for economically backward classes, the entire bench decided to reserve the decision

New Delhi: Central government economically backward class The debate in the Supreme Court on the petition regarding the decision of 10 percent reservation has been completed and the decision in this regard has been reserved. The 10 per cent reservation in education and jobs to the EWS category by the central government was challenged in the Supreme Court.

The central government had decided to give 10 percent reservation in education and jobs to the economically backward people. A total of 30 petitions challenging this were filed in the Supreme Court. A five-judge bench headed by Chief Justice Uday Lalit has completed the hearing. This hearing was going on for the last seven days. Meanwhile, the bench has heard the arguments of both the sides and now the final verdict is being pronounced.

In the year 2019, the central government passed the Economically Weaker Sections Reservation Act, providing 10 percent reservation in government jobs and educational institutions. About 30 petitions were filed in the Supreme Court. In the petitions filed, the 50 percent limit has been mentioned regarding reservation. The petition has challenged the new amendment in Article 102 of the Constitution.

This issue is important in the Supreme Court hearing

Can the 103rd Amendment be said to be violative of the basic structure of the Constitution by allowing states to make special provisions including reservation on the basis of economic parameters? This issue is going to be important. The 103rd Constitutional Amendment provided for 10 percent reservation in government jobs and educational institutions for the economically backward classes except the backward classes, scheduled tribes, in higher educational institutions. For this, Articles 15(6) and 16(6) were added to the Constitution. This amendment empowered the state governments to give reservation on the basis of economic backwardness.
