Elon Musk is seeking a delay in a lawsuit against Twitter until November after discovering new claims against the social media company, according to court filings. The billionaire, who on Tuesday sent a letter to Twitter to cancel the $44 billion deal (roughly Rs. 3,50,000 crore) citing a whistleblower’s claims, has now received fresh information on the microblogging site. The whistleblower provided new details to Musk and his lawyers, after the SpaceX and Tesla chiefs asked the court to give both sides until November to brief their case.

The court filing for the delay comes after Musk’s attorneys on Tuesday sent a new letter to Twitter to include another reason for canceling the deal over whistleblower Peter Zatko’s claims, Reuters reported. Musk is now seeking time to amend his complaint against the social media company.

According to Musk’s attorneys, who filed a motion to amend the complaint under seal in Delaware Chancery Court, the social media company’s problem isn’t limited to bots and spam accounts. This includes data security and other issues as outlined by Zatco.

Musk’s team has asked the judge to continue briefing both sides on their cases until Nov. 10 and let them discuss what evidence they can present at trial. A new trial date could be set in November, Musk said, “subject to court availability.”

Meanwhile, Twitter has asked the court to deny Musk’s request for additional documents prior to 2022. The social media company called its efforts a way to test and delay the deal. Musk and Twitter, who have sued each other, are set to begin a five-day trial on October 17.
