New Delhi : Regarding the tenth schedule Kapil Sibal, counsel for the Thackeray group, argued that the opinion of the Election Commission that it has nothing to do with the Election Commission is wrong. Kapil Sibal read out the notice sent by the Central Election Commission to Shiv Sena and said how it is wrong. He also argued that Uddhav Thackeray is the president of Shiv Sena till 2023.

The hearing of the biggest power struggle in Maharashtra is going on in the Supreme Court and Thackeray group’s lawyer Kapil Sibal objected to the Central Election Commission’s arguments.

Kapil sibbe’s argument

The Election Commission told the Supreme Court that there is no link between the Tenth Schedule and party division. Kapil Sibal said that the opinion of the Commission that MLAs are members of political parties even if they are disqualified, is wrong. It also told the court that how the Tenth Schedule has nothing to do with it is wrong.

Terming this notice wrong, Kapil Sibal said that the beginning of the notice sent by the Election Commission was that there are two factions in Shiv Sena. How did the Election Commission decide that there are two factions in Shiv Sena? If it is being said by the Shinde group that they are in Shiv Sena, the same is being said by the Thackeray group, then how did the Election Commission decide that there are two groups in Shiv Sena?

Uddhav Thackeray is the President of Shiv Sena

Uddhav Thackeray is the president of Shiv Sena till 2023, such documents have been given to the Central Election Commission. Accordingly, Kapil Sibal also argued that Uddhav Thackeray will now be the chief of Shiv Sena, it is in the records of the Election Commission.

Eknath Shinde is not a primary member

Eknath Shinde is not a primary member of the party executive. Kapil Sibal said that he is not directly elected, he is a nominated member. Now that he has left it voluntarily, it was argued that his decision rests with the Deputy Speaker of the Assembly.
